Terms & Conditions

For the purposes of these Terms, "TwynUp™" refers to the TwynUp platform, including its website, mobile application, products, services, features and related offerings made available by Manya Fintech Solutions Pvt. Ltd., the owner and operator of the Platform.

These Terms & Conditions ("Terms") govern your access to and use of the TwynUp platform, including its website, mobile application, products, services, features and any related offerings made available now or in the future (collectively, the "Platform").

By accessing, registering, logging into or otherwise using the Platform, you agree to these Terms. If you do not agree, please do not use the Platform.

TwynUp reserves the right to modify these Terms from time to time. Any revised Terms will become effective upon publication on the Platform. Continued use of the Platform after such publication constitutes acceptance of the revised Terms.

You confirm that you are legally capable of entering into this agreement and that all information provided by you during registration or thereafter is accurate, complete and up to date. If you are using the Platform on behalf of another person or organization, you represent that you have the authority to bind such person or organization to these Terms.

TwynUp is a technology platform designed to enhance and enrich sporting experiences. The Platform may enable users to create, access, receive, view, organize, analyse, share and interact with sporting content, experiences, records, insights, profiles and related digital services. The scope, functionality and features of the Platform may evolve over time at TwynUp's sole discretion.

The Platform may facilitate the creation, capture, recording, collection or generation of photographs, videos, audio, imagery, gameplay, sporting activities, player interactions, achievements, statistics, metadata, analytics, highlights, visualisations, digital records and other forms of content or information associated with sporting activities. Such content may originate through your own use of the Platform, through participation in activities where the Platform is deployed or enabled, through authorised partners or organisers, through automated systems, or through technologies available on the Platform.

By using the Platform, you consent to the creation, capture, collection, processing, storage, display, sharing and use of such content as reasonably necessary to operate, improve and provide the Platform and its services. This includes content in which you appear, participate or are reasonably identifiable in connection with sporting activities supported by the Platform.

You acknowledge that sporting activities conducted using or supported by the Platform may involve media capture within designated playing areas or other relevant sporting environments.

By participating in such activities, you acknowledge that you may appear in photographs, videos or other media created as part of the sporting experience. TwynUp does not guarantee that every activity will be captured, nor that every captured activity will be published.

TwynUp may edit, enhance, crop, combine, compile, format, organise, annotate or otherwise process content for presentation, quality improvement, presentation, analytics, archival purposes, product functionality or other legitimate business purposes, provided that such processing does not materially misrepresent the underlying sporting activity.

Unless expressly stated otherwise, ownership of content created through the Platform remains with the user who creates or initiates that content. By creating or making content available through the Platform, you grant TwynUp a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to host, store, reproduce, process, adapt, publish, communicate, distribute, display and otherwise use such content to the extent reasonably necessary to operate, maintain, improve, develop and promote the Platform and its services. This licence continues for so long as the content remains available on the Platform and thereafter only to the extent reasonably necessary for legal, security, archival or operational purposes.

Content made available through the Platform may depict, identify or otherwise be associated with one or more users through tagging or similar functionality. Such association is intended only to support the functionality of the Platform and does not transfer ownership of the underlying content or create ownership rights for any identified or associated user, without limiting any rights available under applicable law.

TwynUp is a community built around sport and respectful participation. All content uploaded or created on the Platform, including videos, photographs, profile information, usernames, biographies, comments, reactions and tags, is subject to review and moderation by TwynUp.

TwynUp may use human reviewers and automated systems to identify, investigate, restrict or remove content that violates these Terms or applicable law. TwynUp does not guarantee that every upload will be reviewed before publication, but all content remains subject to moderation at any time.

TwynUp may use artificial intelligence, machine learning, computer vision and similar technologies to organise, analyse, interpret, classify, enhance or generate sporting content, insights, recommendations, statistics, summaries or other outputs derived from information available through the Platform. Such outputs are intended to enhance the user experience and should not be regarded as official sporting records unless expressly designated otherwise.

You represent that you have all necessary rights and permissions to create, upload or otherwise make available any content through the Platform and, where such content depicts or identifies other individuals, that you are entitled to do so in accordance with applicable law and these Terms.

You agree not to upload or share unlawful, obscene, sexually explicit or violent content; harass, bully, threaten or stalk another user; misuse the tagging feature to falsely associate, repeatedly target or impersonate another person; upload content without having the necessary rights or permissions; create fake profiles or impersonate individuals or organisations; attempt to bypass another user's block or moderation action; and interfere with the security or normal operation of the Platform.

Users may tag only individuals who genuinely appear in the relevant sporting moment. Any user may remove or untag themselves from content associated with their profile through the Platform's available controls. Repeated unwanted tagging, stalking, impersonation or misuse of tagging may result in immediate restriction of tagging privileges, suspension or permanent account deletion.

The Platform may allow users to block other users. When blocked, certain interactions including profile discovery, tagging and other platform interactions may be restricted. Users must not create alternate accounts or otherwise attempt to circumvent another user's block.

Users may report videos, profiles or other content that they believe is inappropriate, unlawful or violates these Terms. TwynUp reviews reported content and may remove content, issue warnings, suspend accounts or permanently delete accounts where appropriate. Reporting does not guarantee removal, and decisions remain at TwynUp's reasonable discretion.

Users must not knowingly submit false, malicious or abusive reports. Repeated misuse of the reporting feature may result in suspension or termination of the account.

TwynUp may immediately remove any objectionable or inappropriate content and suspend or permanently delete the associated account where it reasonably believes these Terms or applicable law have been violated.

This includes content involving harassment, stalking, hate speech, sexual exploitation, impersonation, unlawful activity, repeated abuse or any conduct that compromises the safety of the TwynUp community. TwynUp may do so without prior notice where necessary to protect users or comply with law.

TwynUp retains all rights, title and interest in and to the Platform, including its software, technology, designs, algorithms, databases, interfaces, trademarks, branding, intellectual property and all improvements thereto. Nothing contained in these Terms transfers ownership of any intellectual property to you except for the limited right to access and use the Platform in accordance with these Terms.

The Platform may contain links to or integrations with third-party products, services or websites. TwynUp does not control such third-party services and accepts no responsibility for their availability, content, policies or practices.

TwynUp may suspend, restrict or terminate access to the Platform at any time where it reasonably believes that these Terms have been violated, where necessary to protect the Platform or its users, or where required by law.

While TwynUp endeavours to provide a reliable and high-quality experience, the Platform is provided on an "as is" and "as available" basis. TwynUp makes no representation or warranty that the Platform will operate uninterrupted, be error-free, capture every sporting activity, generate complete or accurate outputs, or remain continuously available.

To the fullest extent permitted by law, TwynUp, its affiliates, officers, directors, employees, partners and licensors is not liable for any indirect, incidental, consequential, special or exemplary damages, including loss of data, reputation, opportunity, revenue or profits arising from or relating to the use of, inability to use or reliance upon the Platform.

You agree to be responsible for any claims, losses or expenses arising from your breach of these Terms, misuse of the Platform or violation of applicable law.

Nothing in these Terms limits any rights that cannot lawfully be excluded under applicable law.

These Terms will be governed by and construed in accordance with the laws of India. Any dispute arising out of or relating to these Terms or the use of the Platform will be subject to the exclusive jurisdiction of the competent courts in Mumbai, Maharashtra, unless otherwise required by applicable law.

By creating an account or continuing to use the Platform, you confirm that you have read, understood and agree to these Terms.
